摘要/Abstract

本文旨在對基本權利之規定作有系統的分析,除分述基本權利之各種功能面向外,並從法釋義學之角度,闡述其問題之論證步驟,藉以了解基本權利的性格、規範目的及內涵,並建立其理論體系及思考層次,使之成爲一項實用之學,俾供吾國學界及實務界探討基本權利問題之參考。在內容上,本文首先就基本權利之功能體系,作一般性之介述,以彰顯基本權利之內涵。其次,分析基本權利問題之思考層次,並試舉數例予以闡明,爲本文之重心所在。再者,闡述「規範的位階性」與基本權利問題思考層次之關係,以爲補充。最後,略述研究基本權利問題之若干難題,俾供思考,並作結論。

This study attempts to establish the basic structure of funda­mental rights (liberty rights). First, the basic functions of fundamen­tal rights is described: "defensive function", "performance function" and "function of protection". Second, according to the dogmatics or doctrine of fundamental rights this paper provides a "three-step­ assessment" of fundamental rights: area of protection, infringement and justification of infringement. Third, this paper analyzes the rela­tionship between the hierarchy of norms and problems of fundamental rights. And finally, this paper points out some dilemmas and draws some conclusions regarding fundamental rights.
