摘要/Abstract

本文係從憲法理論之角度,針對1999年憲法增修條文所引發之憲法爭議,進行「違憲審査式」之分析與論證,其內容主要分成三大部分:一、探討憲法修改程序之合憲性問題。二丶剖析修憲界限與憲法修改之合憲性問題,包括國大代表及立法委員任期延長之合憲性問題,以及比例代表選舉制與民主原則及選舉平等原則之關係。三、論述憲法條文之違憲審査與宣告方式。最後,作者從比較宏觀的角度,指出此次修憲背後所潛藏之憲法結構缺陷,並對此次修憲作一總結性的評價。

This article provides a critical analysis of the constitutional amend­ments of 1999. It is divided into three sections. First, it reviews the constitutionality of the amendment process. Second, it examines, from a democratic perspective, the constitutionality of the provisions of the con­stitutional amendments that extend the terms of the parliamentarians. Third, it analyzes how the grand justices declare amendments unconsti­tutional. Finally, the author poses some viewpoints about the constitu­tional reforms.
